ART 9 - LEGAL ISSUES AND TERMS OF SERVICE
Art 9, in further reading as A9, is a free-to-join art site, where people can freely submit their artwork, discuss about art and related interests, however, there are limitations to the Terms of Service as follows:
TERMS OF MEMBERSHIP:
Members must remain respectful to their fellow members, this site does NOT allow disrespectful comments and/or slander based on but not limited to a User's gender, age, race, religion, lifestyle, and/or sexual preferance. Users will be warned, and possibly banned, should we find multiple offences.*
Spam and Hate accounts created with intent to harrass, annoy, and disturb the peace in general will not be tolerated and will be deleted without warning.
What is considered disrespectful?
Everyone has a right to an opinion. And just because some one disagrees with you, this doesn't nessisarily mean they are insulting you.
If the language used is derogatory however, it should be reported.
For instance:
You: What if I'm being targeted by cyber bullies/trolls?
Us: Report them, they will be dealt with firmly and swiftly. We will not tolerate users who break the rules.
*Multiple offences? By multiple we refer to more than one individual occasion and/or targeting more than one person. You will receive a warning for each individual offence, more than 3 warnings and a ban will be issued.
TERMS OF SUBMISSION:
Content that falls under this section is not limited to Artwork, stories, poetry, and other works which come under the artistic category. Content also includes comments, journals, notes, basically anything which can be submitted.
This content be it of an artistic nature or not, should NOT contain whole OR in part any of the following:
1.Spam: intended to irritate or annoy.
2.Content which is Hateful: which targets a specific person, gender, age, race, religion, lifestyle, and/or sexual preferance.
3.Disgraceful Material: false information, threatening people and/ or their property, and endorsing, promoting, or encouraging activities that are illegal.
4. Stolen Material: Sharing, tracing, posting without credit to applicable third parties, works which are neither created nor owned by whoever posts it.
5. Underage Nudity: Exposed subjects that are under the age of eighteen(US) or otherwise a minor according to applicable laws.
6. Pornography: Explicit or implied sexual activity/scenes without artistic merit. (that also includes showing character's "bits").
I confirm that the Content I create and/or upload on A9 is my sole creation, and that all influential sources are properly credited. I indemnify A9 from all if any liability connected to the use of my Content. And I confirm that my Content does not violate any laws or regulations which are applicable.
I hereby confirm that any content I upload or submit to A9 is legal under any copyright laws that may apply.
I understand that I upload my Content freely of my own will, and also that no terms, conditions, or contracts outside those within A9's own Terms and Conditions, exist between me and A9. I understand my ability to upload and/or store Content on A9 may be terminated at any time for any reason.
I understand that the terms of this Submission Agreement shall be governed and construed under applicable laws and A9's own guidelines and Terms Of Service. Disputes over laws are between the individuals concerned, (as they submit their content willingly, and of their own accord,) and should take place offsite. Regardless of, wether or not the two individuals have the same law or are in different countries/counties/states.
I confirm that it is my understanding that A9 and its creators are not implifiable or connected in anyway to these disputes, legal and/or otherwise. I understand that A9 staff, and its creators are not responsible for what is being uploaded but will delete stolen artwork, should suspision or notification from myself or other users arise. And issue a ban on it's members as appropriate.
I grant A9 the right to revise the terms of this Submission Agreement by updating this page and it's text. I understand that A9 will not fundamentally and/or morally alter the rights granted to it without my consent. I agree to be bound by subsequent revisions to this agreement 2 weeks (14 days) after the posting of the revised version of this submission agreement, and the notice of said revision posted within a A9 public Newspost. Accordingly, I understand that I should visit this page often to review the current terms of this agreement.
It is also my understanding that if I am under the age of 13 I am not allowed to join A9. And will respect this rule and wait untill my 13th birthday to join. I confirm that if I make my account whislt underage, my membership may be terminated at anytime.
If I am under 18 years of age, or otherwise a minor according to applicable laws, I affirm that I have been granted the permission of a parent or legal guardian to upload my Content, and that this parent or legal guardian has read, understood, and agreed to the terms of this Submission Agreement for my use.
I affirm that I have the legal right to enter into this Submission Agreement, and grant to A9 the rights and licenses outlined within.
Privacy Policy:
A9 will store your personal information for the purpose of proving the accounts set up are made by real people, and not made by a bot for the purpose of spam or advertising.
Neither A9 nor it's staff will pass on your private information to any other party without your expressed consent or unless you ask us to do so, by doing this you acknowledge that by giving us your permission/request you, yourself and not A9 or it's staff are liable. Please be aware that information you make public, is your own responsibility and you make your personal information public at your own risk. This means that you acknowledge A9 and/or it's staff are NOT responsible/to blame/at fault, for your personal information that you submit as you may choose to hide your email address, your date of birth, and is NOT nessisary for you to submit your address, bank details, and/or full name. You should have read this privacy policy prior to reading the TOS (terms of submission). And by aggreeing to the TOS you also state that you have also read this Privacy policy.
It is highly recomended that you NEVER make public the following information*:
